The fee for private appraisal reports and all other valuation activities is charged according to the regulations for architects’ and engineers’ fees (§ 34 HOAI).

Services of court-appointed valuers are charged in compliance with the „JVEG“(fee for experts, interpreters, translators…).

Individual agreements:

In special cases, individual agreements on the expert’s fee are possible and necessary, as sometimes the scale of value of the HOAI does not suit to the range of the expert’s activities. This could be possible for properties where only a small range of services is needed although the property is of considerable value (for example due to a prime location). On the contrary, cases may be possible where the property is of low value and in spite of this, detailed services are needed.

The expert’s fee according to § 34 HOAI

  1. The minimum and maximum rates for the evaluation of properties, buildings and other constructions as well as for the evaluation of property rights are set in the following table:

(2) The fee depends on the value of the properties, buildings and constructions or the value of property rights which is appraised at the moment of evaluation. In case of undeveloped site, the land value is taken into consideration. Should there be further properties (see (1)) within the scope of valuation, the sum of values of the single properties is taken as calculation basis for the expert’s fee.

(4) Depending on the number and importance of difficulties, valuations can be assigned to the level of difficulties (subsection 1, fee table). This must be stipulated in the contract. According to subsection 6, no. 3, the fees for the level of difficulty can be exceeded.
(5) Difficulties may be found in the following:
1. Valuation of
- ground lease, life estate, right of residence as well as other rights
- allocation and compulsory purchase
- fiscal evaluation
- different types of use of a property
- consideration of damage degrees,
- particular risks of, massive dust and dirt or
- other considerable difficulties when making the appraisal

2. Valuations, where the expert must:
provide, overhaul or prepare necessary details, to name a few:
- Procurement and amendment of property details, real estate register and land register details 
- Appraisal of gross receipts
- Appraisal of management and maintenance costs
- If necessary, local surveying of the site
- Preparation of system sketches (scale of own choice)
- Amendment of existing layouts and sectional drawings

3. Evaluations for
- different deadlines,
- which may in particular cases require the examination of principle questions of real estate appraisal and a corresponding written statement.

(6) A decrease of fees, calculated according to subsections 1, 2, 4 and 5, may be possible in the following cases:
- estimated valuations according to existing drafts of banks and insurance companies
(decrease of 30 %).,
- Estimation of fair market value only by considering the real asset or capitalized income value (decrease of 20 %)
- Transfer of already existing value estimations to another point of time (decrease of 20 %)

(7) If a valuation is only amended by some further details and only additions or leavings/surcharges or deductions have to be considered, fees according to the preceding definitions will decrease by 20 %. The same is valid for other completions, where the range of actions will not exceed the range of value estimation described in paragraph 1.
